US Justice Dept. says Norfolk Southern will give Amtrak priority over freight trains.

The U.S. Justice Department announced on Tuesday that it had dismissed a lawsuit filed against Norfolk Southern, after the company agreed to give Amtrak passenger train "highest priority" in comparison to freight trains.

In a press release, the Department of Transportation said that the settlement reached with Norfolk Southern Corp. and Norfolk Southern Railway Company resolved allegations that the transport firm delayed passenger trains along Amtrak’s Crescent Route from New York City to New Orleans in violation federal law.

Norfolk Southern, which controls 1,140-miles of rail on the Crescent Route, dispatches all trains, including those it operates, along this segment.

In July 2024, the Biden administration had sued Norfolk for civil damages. The Biden Administration, which placed a high priority on enhancing passenger rail service, and high-speed rail project, filed a lawsuit against Norfolk.

Federal law requires Norfolk Southern give Amtrak passengers trains priority over freight trains. However, the Justice Department stated at the time, that Norfolk failed to comply with this requirement, "resulting in widespread delays which harm and inconvenience train riders, negatively impact Amtrak's performance and impede passenger railroad transportation".

The settlement also requires Norfolk to train their employees on how to give Amtrak priority in non-emergency situations. It also requires supervisor approval before any dispatching decisions are made that don't give Amtrak priority.
