Thai investigation puts ITD contracts at risk on China-backed rail projects

After an accident halted construction on a China backed high-speed railway project, Thai'state railways' is consulting with the country’s top lawyer about terminating contracts.

After two separate accidents in which 32 people were killed at two ITD sites in consecutive days of January, the public has become more angry. The government and police are now stepping up their scrutiny on a company whose shares fell 53% during the last year.

The board of the railway, which oversees a 609 km (378 mile) high-speed rail linking Thailand with China via Laos, met Thursday to discuss its future contracts with ITD.

Anan Phonimdang said that the board had assigned the State Railway of Thailand (SRT) to consult with the Office of the Attorney General on all aspects of the contracts provisions.

ITD has not responded to the detailed questions sent via email.

Anan made his comments after Anutin Charnvirakul announced that the government would terminate ITD contracts for both projects, and take legal action against them.

The railways sought the approval of the Attorney General to begin this legal process.

Anan stated that the talks included terminating contracts. The company is building two rail sections and a depot, which together stretch 68 km (42 miles).

The crane that collapsed on the highway project of ITD near Bangkok the following day killed two people.

Another incident occurred?last year, when 89 people were killed after an ITD highrise project collapsed in an earthquake. This led to charges of criminal neglect against 23 people including the president of the company.

The Thai credit rating agency, TRIS, predicted that ITD's revenue could fall by as much as 50% in the next 3 years, as compared with 2024.

ITD, Thailand's stock exchange, has stated that it accepts the responsibility of providing care, compensation and remedies to the two most recent incidents.

Thailand's Transport Ministry has called for a 15-day suspension of construction on 14 contracts that involve ITD. They have also launched an investigation into the two projects affected by accidents to determine if there was any wrongdoing.

Chirapong Theppithuck told the media this week that legal action could be taken, depending on the nature of the wrongdoing.

According to Thatchapol Chinwong, a police official in the district of the accident, relatives of those killed and injured have filed complaints.
