UK court rules for lessors over jets that were 'lost in Russia'

The London High Court ruled on Wednesday in favor of aircraft leasing firms in a multibillion dollar legal dispute over jets that have been retained in Russia after the 2022 invasion.

In one of the largest insurance disputes heard in London, AerCap, the world's biggest aircraft lessor, and other firms sued AIG, Lloyd's and Swiss Re, among others.

Settlements, including those reached on the first trial day in October, have reduced the value.

In a summary, Judge Christopher Butcher stated that the aircraft had been lost. "That loss occurred on March 10, 2022 when Russian legislation prohibited the export of aircraft or aircraft equipment out of Russia."

The judge also added that lessees could recover under their "war risk insurers" rather than a more general clause for all risks, since the loss was caused by "an act or an order of the Russian Government".

Butcher said that sanctions imposed by the EU or the US did not prevent insurers from compensating claimants who had lost aircraft leased to Russian Airlines.

AerCap's Herbert Smith Freehills Kramer law firm said that the judgment secured AerCap $1.035 billion, "in additional to substantial recoveries obtained in previous settlements".

AerCap was the leading claimant in a February trial against several insurers. Merx Aviation (formerly Dubai Aerospace Enterprise), Falcon, KDAC Aviation Finance and Genesis were also involved.

Butcher's ruling states that KDAC settled its claims at trial.
